Impact of contamination on Real Property values

Clarion Associates provided expert witness and rebuttal testimony related to this litigation involving claims of residential property value diminution resulting from the contamination caused by two landfills that have emitted perfluorochemicals (PFCs) into nearby groundwater in Lake Elmo, Minnesota.

The plaintiffs claimed the documented presence of PFCs in groundwater emanating from these two landfills had adversely impaired the market value of three homes in nearby neighborhoods. In June 2009, a Washington County jury returned a unanimous verdict in favor of the defendants, awarding no damages to the homeowners.

Scope of Services Provided

  • Assisted the court and jury in determining the market value of plaintiffs’ property and the economic damages, if any, suffered by plaintiffs as a result of the contaminated groundwater emanating from the two Washington County landfills;
  • Evaluated the general accuracy, reliability, and appropriateness of the information and methodology used, and the concluded damages, in the opposing expert’s report;
  • Analyzed Lake Elmo area development trends and neighborhood trends, both inside and outside the groundwater contamination area.
